Automobile expertise services, which play a critical role in the buying and selling of second-hand vehicles in Türkiye, are experiencing significant chaos due to the unclear legal framework. Consumer complaints about high and uncontrolled prices have been increasing, especially recently. High prices, misleading reports and legal gaps in auto expertise services have led to important discussions between buyers and sellers, and have also brought about calls for “urgent regulation” in the sector.
Today, automobile appraisal prices vary between 8 and 10 thousand TL in the market. These prices may be higher depending on the scope and package of the expertise. However, when the expertise reveals a different problem other than the problems declared by the seller, a new chaos begins.

WHO WILL PAY THE APPRAISAL PRICE?
According to the news in Sabah newspaper; So much so that in case of a major malfunction in the vehicle other than the seller’s declaration, the buyer demands that the seller pay the appraisal price. Expertise companies also say that in case of a situation other than the declaration, the expert price must be paid by the seller. However, since there is no legal sanction here, a new debate is ignited.
Sometimes, this situation may even lead to a fight between the parties. The problems related to expertise are not limited to this. While conflicting and flawed reports come out from different expertise centers, buyers may face significant expenses after purchasing the vehicle due to malfunctions that are not included in the expert report.
IT CREATES UNCERTAINTY
Within the framework of the “Trade of Second-Hand Motor Vehicles” regulation, which regulates the buying and selling of second-hand vehicles in Türkiye, pre-sale reports and other obligations are defined. However, this regulation does not provide detailed public tariffs on who will pay the appraisal prices, how they should be paid and how much they should be.
REGULATION REQUIREMENT
Additionally, the bond between buyer and seller has no legal support, the process is based on contracts and consumer rights. Mistakes in the expert report can be considered as defects and fall within the responsibility of the seller. The expert report can serve as evidence in the parties’ theses. However, in case of a defective report, the legal process works in favor of the buyer. Lawyers state that the current regulation creates a lack of standards in the expertise market, which puts consumers at risk.
TAKASBANK MODEL RECOMMENDATION
Experts pointed out that fraud in sending prices for vehicle purchases and sales was prevented with the Takasbank application and said, “The state took control of the situation here. There is no longer any worry of ‘My money is gone, I have been defrauded’.”
A similar regulation and legal sanction needs to come to the expertise system. Previously, prices were 1,000-2,000 TL. There was no such chaos. However, prices have increased a lot recently. Today, no one wants to throw away 8-10 thousand lira. “This leads to fights,” he says.
5 OUT OF 20 VEHICLES HAVE PROBLEMS
The owner of an appraisal company states that an average of 20 vehicle appraisals are carried out in a day and explains: “Almost 5 out of every 20 vehicles have problems other than the declaration. In 1-2 of these 5 vehicles, a fight may break out between the seller and the buyer.”
Because if the fault is serious, the buyer does not want to buy that vehicle. He pays 8-10 thousand liras in vain for a vehicle he will not buy. He rightfully demands this price from the seller. In such cases, if the seller has not reported this problem to the buyer, he must pay the expert price. But they say they don’t know and don’t want to pay.”
CREATE A PORTAL
Experts say that a common pool should be created for expert reports. The proposed system is as follows: “For each car that will be put up for sale, both dealers and personal sellers will have their vehicle appraised. These appraisal reports will be uploaded to the created portal. Just as it is seen whether there is a lien on a vehicle or not.”
Likewise, errors in the vehicle, paint and accident conditions will also be highlighted as documents when the vehicle’s license plate is entered. The seller will add this appraisal price to the price of the vehicle. “In this way, the chaos of expertise will end and the citizen will know what he is buying.”
